When Should I Be Paid Overtime?
California law requires employers to pay overtime wages to employees who work more than eight hours in a day and more than 40 hours during a week.
What Should I Be Paid For Overtime?
State law mandates that employers pay their employees one-and-a-half times the worker’s regular rate of pay for the time worked beyond eight hours for that day, up to and including 12 hours in any workday. It also requires them to pay the overtime rate for the first eight hours worked if this is an employee’s seventh consecutive day of work in a workweek.
Additionally, employees must receive double their regular rate of pay for all hours after the first 12 hours in a workday, and for all hours worked after eight hours on the employee’s seventh consecutive day of work in a week.
An employee’s “regular rate of pay” is defined as the amount of compensation normally earned for the work performed. It can include hourly earnings, a salary, commissions and piecework pay. The regular rate of pay must always be more than the applicable minimum wage. This rate can often be unintentionally or intentionally miscalculated by employers when an employee has a shift differential or receives commissions or bonuses as part of their compensation.
